The FlightFigures App is not a certified aviation tool and is provided for informational and planning purposes only. It must not be used as a primary source for flight planning or operational decision-making.

The Pilot In Command remains solely responsible for the safe operation of the airplane and for verifying all data against official and approved sources, including the Airplane Flight Manual (AFM) and the Pilot’s Operating Handbook (POH).

By using this App, the User acknowledges that:

• The official Airplane Flight Manual (AFM) and Pilot’s Operating Handbook (POH) are the only legally prevailing sources of data.
• The User must independently verify all App results against these official sources before any flight.
• The Author of the Application is fully discharged from any liability arising from the User’s misinterpretation of data or failure to consult official documentation.

These Terms of Service (“Terms” or “Agreement”) apply to the FlightFigures mobile application and are a legal agreement between you, either as an individual or as a representative of an entity (“you” or “User”) and Mickaël Jacques (hereinafter referred to as “Aeliom”, “we”, “us”, or “our”), a self-employed individual registered in Spain and operating under the commercial brand Aeliom, governing your use of the FlightFigures mobile application (the “App”, the “Application”) and its associated services (the “Service”).

Aeliom is a commercial brand used by Mickaël Jacques, a self-employed individual registered in Spain (see Legal Notice).

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with any of these Terms, you may not use the App.

Eligibility and consent

You must be at least 18 years old or the age of legal majority in your jurisdiction to use the FlightFigures app. If you are under 18 or the age of legal majority in your jurisdiction, you must have consent from your parent or guardian to use the App. By using the FlightFigures app, you represent and warrant that you meet these eligibility requirements.

Acceptance of Terms

Your use of the FlightFigures app constitutes your acceptance of these Terms. These Terms may be updated or amended by us from time to time. Your continued use of the App after such updates or amendments signifies your acceptance of the revised Terms.

End-User License Agreement (EULA) & Intellectual Property

1. Ownership – The App FlightFigures, including its source code, design, graphics, and all content, is the sole and exclusive property of Mickaël Jacques, operating under the trade name Aeliom. All rights are reserved.

2. License grant – Aeliom grants you a personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the FlightFigures App on a mobile device that you own or control, strictly for your personal, non-commercial use in accordance with these Terms of Service.

3. Restrictions on use – You agree that you will not, and will not permit any third party to:

   • Reverse Engineering – Decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the App, even for interoperability purposes (to the maximum extent permitted by applicable law).
   • Modification – Modify, adapt, improve, or create derivative works from the App.
   • Redistribution – Rent, lease, lend, sell, redistribute, or sublicense the App.

4. Geographic Restrictions & Export Control – You represent and warrant that

   • you are not located in a country that is subject to a European Union or U.S. Government embargo, and
   • you are not listed on any government list of prohibited or restricted parties.

   You agree to comply with all local and international laws regarding the use of the App and the transmission of technical data.

Mobile In-App purchases

1. The FlightFigures application offers an in-app purchase option which will unlock features listed on the Pricing page under the “Solo Fly” or “Pilot Plus” subscription plans.
2. The in-app purchase is valid only on the ecosystem where the in-app purchase was made (no cross-platform support).
3. The in-app purchase will unlock premium access on all devices within the ecosystem, provided that the devices are signed in under the same ID.
4. All amounts are payable and charged:
   • For monthly subscription and annual subscription, at the beginning of the subscription and, because each such subscription renews automatically for an additional period equal in length to the expiring subscription term until you cancel it, at the time of each renewal until you cancel.
   • You must cancel your subscription before it renews to avoid the billing of the fees for the next subscription period.
   • Your subscription will automatically renew unless auto-renew is turned off at least 24-hours before the end of the current subscription period.
   • Your account will be charged for renewal within 24-hours prior to the end of the current subscription period. Automatic renewals will cost the same price you were originally charged for the subscription.
   • You can manage your subscriptions and turn off auto-renewal by going to your Account Settings on the Apple App Store or Google Play Store after purchase.
   • You can cancel the renewal of your subscription with the Apple App Store or Google Play Store.
   • You will not receive a refund for the fees you already paid for your current subscription period, and you will continue to use premium access until the end of your current subscription period.
   • Apple App Store and Google Play Store subscriptions can be managed from a mobile device or computer that is signed in using the same ID as the initial purchase. Aeliom or FlightFigures team cannot manage these subscriptions.
5. By purchasing any subscription (Pilot Plus), you accept these Terms.

Disclaimer

1. Limitation of liability – The author and owner of the Application will not be liable for any direct, indirect, incidental, special, consequential or punitive damages, including without limitation, loss of life, loss of profits, data, use, goodwill, or other intangible losses, resulting from

   • your access to or use of or inability to access or use the FlightFigures app;
   • any conduct or content of any third party on the App;
   • any content obtained from the App; and
   • unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

2. No warranties – The FlightFigures app and its content are provided on an “as is” and “as available” basis without any warranties of any kind. We do not warrant that the App will operate error-free or that the App, its servers, or the content are free of computer viruses or similar contamination or destructive features. If your use of the App or the content results in the need for servicing or replacing equipment or data, we will not be responsible for those costs.

3. Information accuracy – While effort is made to ensure the accuracy of the information presented in the App, we do not warrant the accuracy, completeness, usefulness or legality of this information and we are not responsible for any errors or omissions in the content provided. The information provided by the App may be based on user input, third-party data sources, or assumptions and may not reflect real-world conditions.

4. Changes and availability – We reserve the right to withdraw or amend the FlightFigures app, and any service or material provided on the App, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the App is unavailable at any time or for any period.

5. External links – The FlightFigures app may contain links to other websites or content belonging to or originating from third parties, or links to websites and features in banners or other advertising. Such external links are not investigated, monitored, or checked for accuracy, adequacy, validity, reliability, availability, or completeness by us.

6. Indemnification – You agree to defend, indemnify, and hold harmless the owner of the Application from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of

   • your use and access of the FlightFigures app, or
   • a breach of these Terms.

7. Data loss and backup – We assume no liability or responsibility for any error, omission, mistake, inaccuracy, or data loss in the FlightFigures app or stored user data. As a User of the App, it is your sole responsibility to back up your user data and keep those records separate from the FlightFigures app.

8. Use at your own risk – The FlightFigures App provides performance calculations, weight and balance data, CG and loading graphs, and related information for general information and planning purposes only. All calculations and results must be independently verified by the pilot in command using the official and approved Airplane Flight Manual (AFM), Pilot’s Operating Handbook (POH), and any other applicable operational documentation.

   The use of the FlightFigures App and any reliance on its content is entirely at the user’s own risk. We shall not be liable for any damage, loss, or injury, including loss of life, resulting directly or indirectly from the use of the App or reliance on any information it provides.

Terms of use

1. To download, install, access or use the App, you must be 18 years of age or over. If you are under 18 and you wish to use download, install, access or use the App, you must get consent from your parent or guardian before doing so.
2. We reserve the right to change these Terms of Use at any time without notice to you by posting changes on the www.flightfigures.com or by updating the App to incorporate the new Terms of use. You are responsible for regularly reviewing information posted online to obtain timely notice of such changes. Your continued use of the App after changes are posted constitutes your acceptance of the amended Terms of Use.
3. Use of the App does not include the provision of a mobile device or other necessary equipment to access it. To use the App you will require Internet connectivity and appropriate telecommunication links until the offline version is fully downloaded. Thereafter, internet connection is needed in order to receive app updates, content updates, and push notifications. We shall not have any responsibility or liability for any telephone or other costs you may incur.
4. You agree not to access, interfere with, disrupt or damage any part of the App, network or any equipment on which the App is stored.
5. You assume sole responsibility for results obtained from the use of the App, and for conclusions drawn from such use. We shall have no liability for any damage or loss caused by errors or omissions in any information, instructions or scripts provided to us by you in connection with the App, or any actions taken by us at your direction.
6. We make no warranty that your access to the App will be uninterrupted, timely or error-free. Due to the nature of the Internet, this cannot be guaranteed. In addition, we may occasionally need to carry out repairs, maintenance or introduce new facilities and functions.
7. We do not warrant that the App will be compatible with all hardware and software which you may use. We shall not be liable for damage to, or viruses or other code that may affect, any equipment (including but not limited to your mobile device), software, data or other property as a result of your download, installation, access to or use of the App or your obtaining any material from, or as a result of using, the App. We shall also not be liable for the actions of third parties.
8. We may change or update the App and anything described in it without notice to you. If the need arises, we may suspend access to the App, or close it indefinitely.
9. The App is independent of any platform on which it is located. The App is not associated, affiliated, sponsored, endorsed or in any way linked to any platform operator.
10. The license granted to you for the App is limited to a non-transferable license to use the App on a mobile device that you own or control and as permitted by these Terms of Use.
11. All intellectual property rights in the App and its content are owned by or licensed to us. Users are granted a limited license to access and use the App and its content for personal, non-commercial purposes in accordance with these Terms.
12. Users are responsible for the content they post on the App, ensuring it does not infringe any intellectual property rights, and is not defamatory, obscene, or illegal.
13. We reserve the right to modify or discontinue the service (or any part or content thereof) without notice at any time.
14. If any provision of these Terms is held to be invalid or unenforceable, that provision will be severed, and the remaining provisions will remain in effect. Failure by us to enforce any right or provision will not be considered a waiver of those rights.
15. These Terms constitute the entire agreement between the User and the owner regarding the App and supersede any prior agreements.

17. User feedback and suggestions are welcome but will be considered non-confidential and non-compensatory, except for the contributions to FlightFigures.
18. We reserve the right to terminate a User’s access to the App under certain circumstances, as outlined in these Terms.
19. We reserve the right to change these Terms at any time. Continued use of the App after such changes will constitute agreement to the new Terms.

Contributions to FlightFigures – Terms of use

In addition to the general Terms of Service above, the following terms apply to users who submit aircraft data or other information to FlightFigures.

1. Authorized Materials & Submissions

Users may only submit digital copies of an airplane’s official Pilot’s Operating Handbook (POH) or Airplane Flight Manual (AFM) for the purpose of expanding the App’s database. No other data formats (Excel, manual entries, etc.) will be considered. By submitting content:

• Copyright & Rights – You confirm and warrant that you own the rights to such content and have obtained all necessary permissions to share the materials and that your submission does not infringe upon any third-party intellectual property rights.
• Authenticity – You certify the authenticity of any official documentation provided.
• License to Aeliom – You grant Aeliom a royalty-free, worldwide, perpetual license to use, transcribe, and transform the technical data contained in the documents (performance figures, weight and balance limits, and operating procedures) into a digital format to be integrated into the App.

2. Data Extraction & Storage

Purpose – Submitted documents are used solely as a reference for data extraction and verification. We will not share, sell, or redistribute the original PDF or image files provided by users to any third party.

Data Deletion – Once the technical data has been successfully extracted, verified, and integrated in the App, We reserve the right to delete the original documents from its servers.

3. Accuracy & Review

All submissions are subject to review and approval by our team. We reserve the right to reject or remove contributions at our discretion.

“As Is” Basis – While we strive for accuracy during the extraction process, all user-contributed data is provided “as is”. The final responsibility for verifying the App’s output against the official AFM/POH remains exclusively with the Pilot in Command.

4. Indemnification

You agree to indemnify and hold harmless Aeliom and its owner from any third-party claims, including copyright infringement claims, arising from the documentation or materials you provided.

Governing Law & Jurisdiction

These Terms are governed by the laws of Spain. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Spain.
